fa نقش حقوق اقتصادی در حمایت از حقوق کار کودکان پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">زمینه و هدف:</span></span></b> <span lang="AR-SA">حقوق اقتصادی آن دسته از حقوق مدون در میثاق بین‌المللی حقوق اقتصادی، اجتماعی و فرهنگی (1966) است که برای اولین بار در اعلامیه جهانی حقوق بشر در سال 1948 مورد توجه قرار گرفته است. حقوق بین‌الملل کار نیز در کنوانسیون سازمان بین‌المللی کار (</span><span dir="LTR">ILO</span><span lang="FA">)،</span><span lang="AR-SA"> به‌عنوان موسسه تخصصی سازمان ملل، کانون توجه بوده است. در رابطه با کودکان، کنوانسیون حقوق کودک در سطح بین‌المللی و قانون حمایت از اطفال و نوجوانان در سطح داخلی، حمایت‌های مشخصی را منظور داشته‌اند. مطالعه حاضر با هدف بررسی نقش حقوق اقتصادی در حمایت از حقوق کار کودکان و تحلیل مشکلات اصلی محافظت از حقوق اقتصادی و کارگری کودکان در حقوق ملی و بین‌الملل انجام گردید.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">روش:</span></span></b> <span lang="AR-SA">این تحقیق به روش توصیفی- تحلیلی و با استفاده از منابع کتابخانه‌ای به انجام رسیده است</span><span lang="FA">. </span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">یافته‌ها:</span></span></b><span lang="AR-SA"> حمایت از حقوق کودک در برابر استثمار اقتصادی و انجام هرگونه کار زیان‌بار در کنوانسیون حقوق کودک (1989)&nbsp; مورد تأکید قرار گرفته است. متأسفانه در اسناد بین‌المللی به عوامل ایجاد کار کودکان و پیش&shy;بینی ضمانت اجرا یا سازوکاری برای حل این معضل توجهی نشده است. پیرو اسناد بین‌المللی، قانون حمایت از اطفال و نوجوانان مصوب 1399 در ایران، نه‌تنها بهره‌کشی اقتصادی را تعریف کرده بلکه وادار کردن طفل یا نوجوان به فعالیت‌هایی نظیر تکدی&shy;گری و قاچاق و هرگونه فعالیتی که موجب ورود آسیب به ‌سلامت جسمی، روانی و اجتماعی، اخلاقی، امنیت یا وضعیت آموزش وی گردد را به‌ عنوان وضعیت مخاطره‌آمیز محسوب کرده است که موجب مداخله فوری و حمایت قانونی خواهد شد.</span><span lang="FA"><span style="font-family:"B Nazanin""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">نتیجه‌گیری:</span></span></b> <span lang="AR-SA">حمایت از کودکان در محیط کار و حفاظت در برابر بهره‌کشی اقتصادی زمانی به اهداف عالی خود می‌رسد که سایر حقوق آن‌ها که در کنوانسیون مورد تصریح قرار گرفته است، از جمله حق بهره‌مندی از تأمین اجتماعی (ماده 26)، حق داشتن استاندارد زندگی مناسب برای رشد جسمی، روحی، معنوی، اخلاقی و اجتماعی (ماده 27) و حق محافظت در برابر کارهایی که سلامت، تحصیلات یا پیشرفت کودک را تهدید می‌کند (ماده 32)، برای تمام کودکان به‌طور برابر و یکسان و با هر شرایط سنی تحقق یابد</span><span lang="FA">. </span><span lang="AR-SA"><span style="font-family:"B Nazanin""></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="background:#f4fefe"><b><span style="color:#03695f">Background and Aim:</span></b> Economic law is one of the rights enshrined in the International Covenant on Economic, Social and Cultural Rights (1966), first enshrined in the Universal Declaration of Human Rights in 1948. International labor law is also enshrined in the International Labor Organization (ILO) Convention as a specialized agency of the United Nations<span lang="EN">. </span>In relation to children, the Convention on the Rights of the Child at the international level and the Law on the Protection of Children and Adolescents at the domestic level have provided specific protections. This study aims to examine the role of economic rights in protecting children&#39;s labor rights and analyze the main problems of protecting children&#39;s economic and labor rights in national and international laws. </span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Method:</span></b> The present study has been done using descriptive-analytical method and using library resources<span lang="EN">.</span></span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Results:</span></b><b> </b>Protecting the rights of the child against economic exploitation and doing any harmful work is emphasized in the Convention on the Rights of the Child (1989). Unfortunately, international documents do not pay attention to the factors that create child labor and provide enforcement guarantees or mechanisms to solve this problem. Following the international instruments, the Law on the Protection of Children and Adolescents (1399) of the Islamic Republic of Iran not only defines economic exploitation but it also considers forcing a child or teenager to engage in activities such as begging and trafficking, and any activity that causes damage to his physical, mental, social and moral health and security, or educational status, as a risky situation which will cause immediate intervention and legal support.</span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Conclusion:</span></b><b> </b>Protection of children in the work environment and protection against economic exploitation will reach their high objectives if the other rights specified in the convention, including the right to benefit from social security (Article 26), the right to have a standard of living suitable for growth physical, mental, spiritual, moral and social rights (Article 27) and the right to protection against actions that threaten the child&#39;s health, education or development (Article 32), should be realized equally for all children with all age conditions<span lang="EN">.</span><span dir="RTL" style="font-family:"Times New Roman","serif"" lang="AR-SA"></span></span><br> <br> <b>Please cite this article as:</b><br> Mohammadi M, Mirabi SP.
