fa ابعاد مسؤولیت حقوقی در سزارین نابهنگام در پرتو حقوق بنیادین جنین پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">زمینه و هدف: </span></b><span lang="FA">سزارین نابهنگام، دستبرد در روند زایمان با هدف تولد تقویمی در تاریخ دلخواه بدون معاذیر پزشکی است. این ناهنجاری رفتاری در سال‌های اخیر بیش از هر زمان، گریبان اجتماع را گرفته و روند رو به رشدی می‌پیماید، به نحوی که اگر برای علاج آن فکری نشود، تبدیل به عرف جاری شده و مواجهه حقوقی با آن دشوارتر خواهد شد.</span><b><span dir="LTR"><span style="font-family:"Times New Roman","serif""></span></span></b></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">روش:</span></b><span lang="FA"> مطالعه حاضر به روش توصیفی ـ تحلیلی، مبانی و ابعاد مسؤولیت حقوقی ناشی از سزارین نابهنگام را مورد بررسی قرار می‌دهد. </span><span lang="FA"><span style="font-family:"Times New Roman","serif""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">یافته‌ها:</span></b><span lang="FA"> سزارین نابهنگام به لحاظ اختلال در روند طبیعی تولد کودک و قراردادن او در معرض عوارض و مخاطرات، نقض حقوق اساسی و بنیادین کودک از جمله حق بر حیات و حق بر سلامت و به طور خاص حق برخورداری از دوران کامل جنینی، محسوب می‌شود. متناظراً ملاحظات فقهی، اخلاقی و حقوقی این پدیده حاکی از امکان طرح مسؤولیت حرفه‌ای، مدنی و کیفری حسب مورد برای پزشکان خاطی است، ضمن این‌که باید در نظر داشت والدین نیز در انجام این امر شریک تخلف پزشک خواهند بود.</span><span dir="LTR"><span style="font-family:"Times New Roman","serif""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">بحث و نتیجه‌گیری: </span></b><span lang="FA">به علت فقدان قدرت بزه‌دیده بر طرح دعوا و اتفاق والدین و پزشک نسبت به دستکاری در تاریخ زایمان، پیگیری حقوقی عمل سزارین نابهنگام با مانع مواجه است. بر این اساس، بایسته است در چارچوب سازواره نظام حقوق سلامت، با تأکید بر جنبه عمومی تخلف سزارین نابهنگام، ضمن استمداد از قوانین جاری و همچنین تدوین مقررات و آیین‌نامه‌های اجرایی، در کنار برخورد با متخلفین، نسبت به ممانعت مراکز درمانی از این امر، اقدامات لازم صورت پذیرد.</span><span dir="LTR"><span style="font-family:"Times New Roman","serif""></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><b>Background and aim: </b>Malapropos <span lang="EN">Cesarean</span> is <span lang="EN">an intervention in the delivery process aimed at giving birth to a favorite date without medical necessities</span>. <span lang="EN">This behavioral anomaly has challenged society more than ever in recent years and so is increasing in a way that, if left unaddressed, will become a moral norm and difficult to deal with legally.</span><span style="font-family:"Times New Roman","serif""></span><br> <b>Method:</b> This study conducted to <span lang="EN">a descriptive -</span> analytic study that examines the basics and dimensions of legal liability arising from Malapropos <span lang="EN">Cesarean.</span><span style="font-family:"Times New Roman","serif""></span><br> <b>Results: </b>Malapropos <span lang="EN">Cesarean Because of the disruption to the child&#39;s natural birth process and</span> <span lang="EN">putting him at risk</span> <span lang="EN">can be regarded as a violation of the </span>basic <span lang="EN">and fundamental rights of the child</span> <span lang="EN">including the right to life and the right to health and in particular </span>fetal <span lang="EN">right to spend a full period</span><span lang="EN"> in the </span><span lang="EN">womb. Accordingly, jurisprudential, ethical and legal considerations of this social phenomenon indicate the possibility of professional, civil and criminal liability for physicians.
