fa ضرورت شناسایی و حمایت از حق شادی کودکان در نظام حقوق داخلی و بین‌الملل پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span lang="FA">افزایش تجربه‌ها و پیشرفت‌های بشر، تأثیر مستقیم در تحولات اجتماعی و حقوقی داشته است. به عنوان نمونه، دیگر امروزه حق‌های سنتی مانند حق حیات و حق بر امنیت تن، در شمار بدیهیات شمرده می‌شوند و حق‌های کم‌تر شناخته‌شده‌ای وارد گفتمان حقوق داخلی و بین‌المللی شده‌اند. حق شادی با تأکید بر &laquo;حق شادی کودکان&raquo; به عنوان یکی از این حق‌های نسبتاً نوظهور وارد ادبیات حقوق بین‌الملل و حقوق داخلی برخی کشورها شده است تا جایی که بعضاً به عنوان یکی از شاخص‌های توسعه‌یافتگی کشورها قلمداد می‌شود. نویسندگان مقاله، با شیوه گردآوری اطلاعات به طریق کتابخانه‌ای و بررسی داده‌ها به شیوه توصیفی ـ تحلیلی و تطبیقی با تبیین مفهوم شادی در فلسفه، عرفان، اخلاق، ادبیات و فقه در تلاش هستند تا &laquo;هست‌ها&raquo; و &laquo;بایدها&raquo; در حوزه حق شادی کودکان را بررسی نمایند. آنچه محصل شده است این‌که نهادهای مردم‌نهاد (جامعه مدنی) و سازمان‌های دولتی مانند وزارت آموزش و پرورش و کانون پرورش فکری کودکان و نوجوانان، هنوز با وجود ارجگذاری به برخی دستاوردهای مثبت آن‌ها، به دلایلی از جمله کم‌تر شناخته‌بودن این حق، عدم اولویت این حق نزد سیاستمداران، فقدان هماهنگی میان سیاست‌ها و مدیران و در نهایت، برخی مشکلات در ساختار فرهنگی و اقتصادی، از رسالت حقیقی خود فاصله دارند که ضمن شناسایی و معرفی برخی از مهم‌ترین کاستی‌ها و چالش‌ها، به ارائه پیشنهادات متناسب با آن‌ها مبادرت شده است.</span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="unicode-bidi:embed">The increased human beings experiences and improvements have direct effect on social and legal developments. As a sample, the classic rights such as the right to life and the right to body immunity are counted as obvious and normal rights. The less-known rights have been appeared in both internal and international law. The right to happiness with emphasis on child happiness is one of these new phenomenons. This right obtains its situation as a new generation of developing factors by some countries. The authors search and explain by library-based studying method on the concept of happiness in <span style="letter-spacing:-.1pt">philosophy, theosophy, morality, literature and religious jurisprudence</span>. Then, (facts) and (norms) about joining of children happiness and legal system are discovered. The results show us non-governmental organizations and governmental ones such as teaching and cultivation ministry or Institute for the intellectual development of children and young adults in spite of their advantageous services are far from their real missions.
