fa حمایت از حق حیات کودک در مخاصمات مسلحانه از دیدگاه اسلام و اسناد بین‌المللی با نگاهی به کودکان یمن پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span lang="AR-SA">حق حیات مهم‌ترین حق طبیعی هر انسانی به ویژه کودک است. این حق پایه و اساس تمام حقوق بشری به شمار می‌رود و هرگونه تعرض به آن نقض صریح و آشکار حقوق بنیادین بشر محسوب می‌گردد. </span><span lang="FA">بر اساس آموزه‌های اسلام و تصریح بسیاری از اسناد بین‌المللی، کودک به عنوان یک انسان حق دارد که حیات و زندگانی او تحت هر شرایطی به نحو شایسته‌ای تأمین گردد. امروزه با درگیری‌های مسلحانه‌ای که استکبار جهانی برای دستیابی به منافع اقتصادی و سیاسی خود در برخی کشورها از جمله یمن به راه انداخته‌اند، حقوق مسلم کودکان از جمله حق حیات، حق بهداشت، حق تحصیل آنان، به طور آشکاری تهدید و نقض شده است و هر ساله هزاران کودک یمنی در اثر این درگیری‌ها جان خود را از دست می‌دهند. در پژوهش حاضر که با روش توصیفی ـ تحلیلی و تطبیقی صورت گرفته، ضمن بررسی مبانی حق حیات کودک در اسلام و اسناد بین‌المللی و آثار مخاصمات مسلحانه بر حیات کودکان، حق حیات کودکان یمن مورد بحث و بررسی قرار گرفته و بیان گردیده است که بر همه افراد جامعه انسانی، نهادهای ملی و بین‌المللی و دولت‌ها لازم است که در حد توان، ساز و کارهای تأمین این حق را فراهم کنند و از بروز خشونت علیه کودکان در مخاصمات مسلحانه جلوگیری کنند.‌ علاوه بر این ضرورت دارد افرادی که حیات کودکان را در مخاصمات مسلحانه به خطر می‌اندازند، به اتهام جرائم جنگی، تعقیب، محاکمه و مجازات شوند.</span><span lang="AR-SA"><span style="font-family:"B Nazanin""></span></span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="unicode-bidi:embed"><span style="background:white">The right to life is the most important right of any human being, especially the child.</span> <span style="background:white">This right is the cornerstone of all human rights and any violation of it is a gross and grave violation of fundamental human rights.</span> <span style="background:white">According to the teachings of Islam and many International Instruments, the child, as a human being, has the right to a decent living and life under any circumstances.</span> <span style="background:white">Today, with armed clashes waged by global arrogance to achieve their economic and political interests in some countries, including Yemen,</span> <span style="background:white">the inherent rights of children, including the right to life, the right to health, the right to education, have been clearly threatened and violated and every year thousands of Yemeni children die as a result of these clashes. Theis study is a descriptive-analytical and comparative study that examine the fundamentals of the right to life of child in Islam and international Instruments and the effects of armed conflict on child rights.
