fa روح حقوق کودک؛ نگاهی به اهداف حقوق کودک در رویکردی تطبیقی پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span dir="RTL" lang="FA"><span style="letter-spacing:.1pt">پاسخ‌دهی به این سوال که نظام حقوقیِ کودکان به چه منظوری وضع شده است قبل از هر چیز مستلزم آگاهی از مبنای حقوق کودک است. شناخت این مبانی هم در گرو شناسایی اهداف حقوق کودک در نظامات اجتماعی می‌باشد. از این‌روست که میان مبنا و اهداف رژیم حقوقی کودکان یک پیوستگیِ قطعی وجود دارد. آگاهی از این مبانی و اهداف به تحصیل درکی صحیح‌تر از فلسفه و کارکردهای حقوق کودک و قوانین و مقررات متناظر در جامعه کمک نموده و نظام قانونگذاری عمومی و سیاستگذاری جنایی را در تقنین قواعد و موازینِ حمایتی مطلوب‌تر در قبال خردسالان در جامعه یاری می‌دهد</span></span><span dir="RTL" lang="AR-SA"><span style="letter-spacing:.1pt">. </span></span><span dir="RTL" lang="FA"><span style="letter-spacing:.1pt">راجع به اهداف حقوق کودک در سطوح ملی و جهانی نمی‌توان از یک اتفاق‌نظر سراغ گرفت. برای این نظام حقوقی اهداف مختلفی برشمرده شده که لزوماً در مقام عمل در همۀ جهات همسو و هم‌طریق هم نیستند. این مقاله با روشی توصیفی- تحلیلی سعی در شناسایی و تبیین اهداف حقوق کودک داشته است و در این مسیر نگاهی اجمالی هم به رویکرد اسناد و موازین بین‌المللی و نیز نظام حقوقی ایران و خصوصاً قانون حمایت از اطفال و نوجوانان مصوب 1399 افکنده است. یافته‌های تحقیق نشان می‌دهد که صیانت از منافع عالیه کودکان، مهمترین مبنای حقوق کودک و ابدیت‌بخشیدن به حقِ حق‌داشتن برای کودکان، توانمندسازی خانواده‌ها و زمینه‌سازی برای رشد مادی و معنوی آنها از مهمترین اهدافِ خاص این نظام حقوقی می‌باشند.</span></span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span lang="EN-CA">Answering to this question of what is the purpose of creating children rights, first of all steps requires knowledge of the basis of children rights. Understanding this rules also requires constructing the goals of children rights in the social societies. Because of this reason, there is a certain connection between the rules and goals of the children legal regime. Understanding of this rules and goals help to gain a more accurate awareness in regard philosophy and legal functions of children rights in society, and this act helps the public and criminal legislative to legislate more favourable child protection rules. There is no national or global consensus on the goals of children rights. There are different goals for this legal system that are not necessarily compatible. This study tries to identify the goals of children rights by descriptive- analytical method, and in this direction, a brief look at the approach of international documents and standards, as well as the Iranian legal system especially the law on the protection of children.
