fa سیاست جنایی تقنینی در نظام حقوقی ایران در قبال نقض حقوق کودک در بستر بازی­‌های رایانه‌­ای پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">زمینه و هدف:</span></span></b> <span lang="AR-SA">تحولات بنیادین در پرتو پیشرفت فناوری‌&shy;ها و شتاب گسترش بازی&shy;‌های رایانه&shy;‌ای توأم با افزایش قدرت تاثیر آن بر اندیشه و رفتار انسان&shy;‌ها، حمایت کیفری از کودکان در&shy; برابر بازی&shy;‌های رایانه‌&shy;ای را اجتناب نا&shy;پذیر می&shy;‌نماید. از یک طرف، پذیرایی کودکان به سبب علاقه شدید آنان از بازی&shy;‌های رایانه&shy;‌ای و از طرفی دیگر، طیف وسیع این قبیل بازی&shy;‌ها با سرمایه‌&shy;گذاری‌های کلان به منظور تدوین بازی&shy;ه‌ای رایانه‌&shy;ای در رده سنی کودکان در کنار عوارض ناسالم و آثار زیان&shy;بار آن بر این قشر آسیب&shy;‌پذیر، نگرانی&shy;‌های بسیاری را برای صاحبان اندیشه برانگیخته است. در این پژوهش، سیاست&shy;‌های جنایی نظام حقوقی ایران در خصوص نقض حقوق کودکان در بستر بازی&shy;‌های رایانه‌&shy;ای ضمن مقایسه با اسناد بین‌&shy;المللی از نگاه نقادانه به جهت ارزیابی آن، محل بررسی قرار گرفته و با پرداختن به نقاط قوت و ضعف قوانین مرتبط بر لزوم وضع مقررات جامع حمایتی از حقوق کودک در برابر آسیب&shy;‌های ناشی از &nbsp;بازی‌های رایانه‌ای با تدوین سیاست جنایی افتراقی کارآمد تاکید شده است</span><span lang="FA">.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">روش:</span></span></b> <span lang="AR-SA">روش بحث در تحقیق حاضر به صورت توصیفی</span><span lang="FA">-</span><span lang="AR-SA"> تحلیلی و روش جمع&shy;‌آوری اطلاعات به شیوه کتابخانه&rlm;&shy;‌ای است</span><span lang="FA">.<span style="color:black"></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">یافته‌ها:</span></span></b><span lang="AR-SA"> در نظام حقوقی ایران بررسی قوانین مرتبط با تمیز سیاست جنایی فعلی در قبال نقض حقوق کودک در زمینه تدوین، نشر و عرضه بازی&shy;ه‌ای رایانه&shy;‌ای،</span> <span lang="AR-SA">خلأها و نقص&shy;‌هایی را آشکار می‌&shy;نماید.</span><b><span style="font-family:"B Nazanin"" lang="FA"></span></b></span></span><br> <b><span dir="RTL" lang="AR-SA"><span style="color:#03695f">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA">از طریق بررسی وضع کودک و حقوق ایشان در برابر بازی&shy;ه‌ای رایانه&shy;‌ای و مطالعه آثار منفی و عوارض نامناسب این فناوری فراگیر و اثر&shy;گذار بر روی کودکان می&shy;توان به تدوین برنامه جامع حمایتی در&shy;بر&shy;دارنده سیاست&shy;‌های جنایی متمایز در برابر بزه‌&shy;دیدگی کودکان بر اثر کاربری بازی&shy;‌های رایانه&shy;‌ای دست پیدا کرد</span><span dir="RTL" lang="FA">. </span><span dir="RTL" lang="AR-SA">رویکرد افتراقی در حقوق کیفری ماهوی در حیطه تأمین امنیت کودکان در حوزه بازی&shy;ه‌ای رایانه‌&shy;ای، نقشی است که مقنّن می‌&shy;تواند برای حفاظت از کودکان ایفاء نماید و مآلاً از سوء استفاده نسبت به حقوق این گروه در معرض آسیب جلو&shy;گیری به عمل آورد</span><span dir="RTL" lang="FA">.</span></span><br> &nbsp;</span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="background:#f4fefe"><b><span style="color:#03695f">Background and Aim:</span></b> Criminal protection of children against computer games following the fundamental transformation in the light of technological advances and the spread of computer games along with increasing the power of its impact on human thought and behavior is inevitable. On the one hand, entertaining children due to their strong interest in computer games, and on the other hand, the wide range of such games with large investments to develop computer games in the age group of children In addition to the unhealthy and harmful effects on this vulnerable group has raised many concerns for thinkers. In this study, the criminal policies of the Iranian legal system regarding the violation of children&#39;s rights in the context of computer games compared with international documents and from a critical point of view has been evaluated and by perusing the strengths and weaknesses of related laws, the need for comprehensive rules to protect the rights of the child against harming of computer games has been emphasized by formulating an effective differential&nbsp;criminal policy.</span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Method:</span></b> The method of discussion in this research is descriptive-analytical and the method of data gathering is library.<span style="font-family:"Times New Roman","serif"" lang="EN"></span></span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Results:</span></b><b> </b>In Iran&#39;s legal system, a review of the laws related to the current criminal policy regarding the violation of children&#39;s rights in the field of creating, publishing and distributing computer games reveals gaps and defects. </span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Conclusion:</span></b><b> </b>By examining the situation of children and their rights against computer games and studying the negative and inappropriate effects of this universal and effective technology on children it is possible to achieve a comprehensive support program containing differential&nbsp;criminal policies against child victimization through the use of computer games.
