fa چالش‌های دولت ایران در برابر حقوق کودکان کار با توجه به حقوق بین‌الملل Challenges of the Iranian Government in Relation to the Rights of Child Laborers in Light of International Law تخصصي Special پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: این مقاله به بررسی چالش‌های دولت ایران در زمینه حقوق کودکان کار با توجه به الزامات و استانداردهای حقوق بین‌الملل پرداخته و تحلیل جامعی از وضعیت فعلی و نیازهای اصلاحی در این حوزه ارائه می‌دهد. هدف اصلی تحقیق، شناسایی مشکلات و ضعف‌های موجود در سیاست‌ها و قوانین مربوط به حقوق کودکان کار و مقایسه آن‌ها با استانداردهای بین‌المللی است. یافته‌های تحقیق نشان می‌دهد که فقر اقتصادی، بیکاری و کمبود فرصت‌های آموزشی، از جمله عوامل اصلی مؤثر در افزایش پدیده کار کودکان در ایران هستند. شرایط سخت و بهره‌کشانه کار برای کودکان، تأثیرات منفی جدی بر سلامت جسمی و روانی آن‌ها و آینده تحصیلی و شغلی‌شان دارد، در حالی که قوانین موجود، مانند «قانون کار» و «قانون حمایت از کودکان و نوجوانان»، به طور نسبی به حقوق کودکان پرداخته‌اند، ضعف‌های اجرایی و نواقص نظارتی مانع از تحقق کامل اهداف این قوانین شده است. روش: در این پژوهش از رویکرد تحلیلی و تطبیقی استفاده شد؛ اسناد بین‌المللی مانند کنوانسیون حقوق کودک و معاهدات ILO در کنار قوانین ایران بررسی شدند و داده‌های کیفی، گزارش‌ها و مصاحبه‌ها تحلیل گردید. یافته‌ها: نتایج نشان داد فقر، بیکاری، ضعف آموزش و اجرای ناکارآمد قوانین از عوامل اصلی کار کودکان در ایران هستند و اقدامات موجود نسبت به استانداردهای جهانی ناکافی است. نتیجه‌گیری: ایران برای بهبود حقوق کودکان کار نیازمند اصلاحات ساختاری، تقویت نظارت، و توسعه برنامه‌های حمایتی و آموزشی است تا با تعهدات بین‌المللی هماهنگ گردد.</div> <div style="text-align: justify;">Background and Aim: This article examines the challenges of the Iranian government in the field of child labor rights according to the requirements and standards of international law and provides a comprehensive analysis of the current situation and reform needs in this field. The main purpose of the research is to identify the problems and weaknesses in the policies and laws related to the rights of working children and compare them with international standards. The findings of the research show that economic poverty, unemployment, and lack of educational opportunities are among the main factors that increase the phenomenon of child labor in Iran. Harsh and exploitative working conditions for children have serious negative effects on their physical and mental health and their educational and career future. While the existing laws, such as the "Labor Law" and the "Law on the Protection of Children and Adolescents", have relatively addressed the rights of children, the implementation weaknesses and regulatory deficiencies have prevented the full realization of the goals of these laws. Method: This study employed an analytical and comparative approach, reviewing international conventions such as the CRC and ILO treaties alongside Iranian legal frameworks, supported by qualitative data, reports, and expert interviews. Results: Results reveal that poverty, unemployment, lack of quality education, and weak enforcement of laws are the main drivers of child labor in Iran, while existing efforts remain insufficient compared to international standards. Conclusion: The study concludes that Iran needs structural reforms, stronger monitoring systems, and effective educational and social support programs to align with global commitments and improve the protection of child labor rights.
