fa کودک شبیه‌سازی‌شده در حقوق ایران و حقوق بین‌المللی The Cloned Child in Iranian and International Law تخصصي Special پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: امروزه به موازات پیدایش تکنولوژی‌های نوین بشری، چالش‌های جدیدی برای حوزه‌های گوناگون حقوقی، پزشکی، اجتماعی و... به وجود آمده است. از جمله پدیده‌های نوظهور، موضوع کودک شبیه‌سازی شده است که با سیاست افزایش توالید در جوامع کم‌جمعیت و یا با تمایل زوجین ناتوان از فرزندآوری به تولید مثل، رو به افزایش است. از آنجا که پدیده شبیه‌سازی کودک مسبوق به سابقه نبوده، بسیاری از پیامدهای ناشی از آن در حوزه‌های گوناگون نیازمند پیش‌بینی و تدارک راه حل و پاسخ است، از جمله اینکه آیا شبیه‌سازی از نظر قواحد حقوقی قابل پذیرش است یا خیر؟ و بر فرض پذیرش، موضوع اصل و نسب کودک شبیه‌سازی‌شده به چه کسی منتسب بوده و حقوق او بر عهده چه کسی است؟ پژوهش حاضر به روش توصیفی ـ تحلیلی درصدد پاسخ به این پرسش مهم است و با بهره‌مندی از داده‌های پزشکی، می‌کوشد که نظر قواعد حقوقی داخلی و بین‌المللی را در این زمینه بیابد. </div> روش: نگارش حاضر به روش کتابخانه‌ای، یافته‌ها و داده‌های پژوهشی مرتبط با موضوع را گردآوری، توصیف و تحلیل نموده است. یافته‌ها: به نظر می‌رسد که شبیه‌سازی به روش‌های متعددی مانند لقاح مصنوعی، اهدای جنین، رحم جایگزین و... صورت می‌پذیرد که هر یک دارای حکم متفاوتی از نظر حقوقدانان و قانونگذار دارد. همچنین نگرش حقوق ایران به تأسی از رأی مشهور فقهی، روش تولیدی، از آن جهت که ولایت پدری به کسی واگذار نشده، انتساب کودک به صاحبان سلول به رسمیت شناخته نمی‌شود، در حالی که حقوق بین‌المللی به ویژه در کشورهای اروپایی مانند انگلستان، فرانسه و آلمان، ولایت کودک شبیه‌سازی‌شده را پذیرفته و رسمی نموده است. نتیجه‌گیری: لذا با توجه به افزایش جنین شبیه‌سازی در جامعه کنونی، موضوع نیازمند بازبینی و تدوین مجاری قانونی است. Background and Aim: Today, in parallel with the emergence of new human technologies, new challenges have arisen for various legal, medical, social, etc. fields. Among the emerging phenomena is the issue of cloned children, which is increasing with the policy of increasing birth rates in low-population societies or with the desire of couples incapable of having children to reproduce. Since the phenomenon of child cloning is not unprecedented, many of its consequences in various fields require prediction and preparation of solutions and responses; including whether cloning is acceptable in terms of legal rules or not? And assuming acceptance, to whom is the issue of the origin and lineage of the cloned child attributed and who is responsible for his rights? The present study seeks to answer this important question using a descriptive-analytical method and, by utilizing medical data, tries to find the opinion of domestic and international legal rules in this field. <div style="text-align: justify;">Method: The present writing has collected, described and analyzed research findings and data related to the subject using a library method.</div> Results: It seems that cloning is done through various methods such as artificial insemination, embryo donation, surrogate uterus, etc., each of which has a different ruling from the point of view of jurists and legislators. Also, the attitude of Iranian law to the famous jurisprudential opinion, the method of production, since the paternal guardianship is not assigned to anyone, the assignment of the child to the owners of the cells is not recognized, while international law, especially in European countries such as England, France and Germany, has accepted and formalized the guardianship of the cloned child. Conclusion: Therefore, given the increase in cloned embryos in today's society, the issue requires review and development of legal channels. Please cite this article as: Keykavosi SM. Nikfarjam Z.
