fa مقررات وضع‌شده توسط شورای اروپا و اتحادیه اروپا علیه گسترش پورنوگرافی کودکان از طریق اینترنت Regulations Established by the Council of Europe and the European Union against the Spread of Child Pornography through the Internet تخصصي Special پژوهشي Original Article زمینه و هدف: کودکان در فضای مجازی قربانی مسائل متععدی از جمله پورنوگرافی هستند. اشخاص و شرکت‌هایی که به واسطه زیاده‌خواهی از کودکان به عنوان ابزاری برای مقاصد شوم خود استفاده می‌کنند. در این مقاله هدف اصلی تبیین تلاش‌هایی هست که از طرف شورای اروپا و اتحادیه اروپا برای جلوگیری و گسترش این مقاصد شوم مثل پورنوگرافی کودکان، است. تلاش‌هایی که با وضع قوانین پیشگیرانه و الزام کشورهای متعاهد برای پیوستن بدان و اجرای این مقررات صورت گرفته است. روش: در این مقاله نوع تحقیق نظری، روش تحقیق توصیفی ـ تحلیلی می‌باشد که با ابزار فیش با استفاده از منابع کتابخانه‌ای تنظیم شده است. یافته‌ها: یافته‌ها حاکی از آن است که تلاش‌هایی که از طرف شورای اروپا و متعاقب آن اتحادیه اروپا در جلوگیری و گسترش پورنوگرافی کودکان در فضای مجازی صورت گرفته است، یکی از اولین تلاش‌های مجامع بین‌المللی در قبال آن بوده است. درست است که قلمرو حاکمیتی این تلاش‌ها صرفاً اروپا و کشورهای موجود در ان قلمرو را شامل می‌شود، ولی از آنجایی که این تلاش‌ها می‌توانند جزء قواعد الگویی و نمونه برای سایر کشورهای جهان تلقی شوند، می‌توانند در استانداردسازی قوانین جدید وضع‌شده راجع به جلوگیری از گسترش پورنوگرافی کودکان مفید باشند. نتیجه‌گیری: شورای اروپا با وضع احکامی در جهت جلوگیری و گسترش پورنوگرافی کودکان در فضای مجازی توانسته آن را به نوعی جرم‌انگاری کند و با توجه به اینکه کشورهای امضاکننده آن را مختار گذاشته که این مقررات را با توجه به حقوق و مقررات موضوعه خود بومی‌سازی کند، لذا توانسته گامی محکم در جهت جلوگیری از گسترش این بزه فراهم آورد. همچنین تلاش‌هایی که از طرف اتحادیه اروپا متعاقب تلاش‌های شورای اروپا صورت‌گرفته در جهت نهادینه‌کردن این مقررات پیشگیرانه می‌تواند تلقی شود. Background and Aim: Children in cyberspace are victims of many problems, including pornography. Individuals and companies that use children as tools for their nefarious purposes. In this article, the main goal is to explain the efforts of the Council of Europe and the European Union to prevent and spread these evil intentions such as child pornography. The efforts that have been made by establishing preventive laws and requiring the contracting countries to join them and implement these regulations. Method: In this article, the type of theoretical research is the descriptive-analytical research method, which was prepared and using library resources. Results: The findings indicate that the efforts made by the Council of Europe and subsequently by the European Union to prevent and spread child pornography in the virtual space were one of the first efforts of the international community. It is true that the sovereign territory of the efforts made in the Council of Europe and the European Union only includes Europe and the countries in that territory, but since these efforts can be considered among the model rules and examples for other countries in the world, they can The standardization of the new laws established to prevent the spread of child pornography will be useful. Conclusion: The result obtained from this study is that the Council of Europe has managed to criminalize it in a way by passing laws to prevent and spread child pornography in cyberspace and considering that the signatory countries have left it free to do this. To localize the regulations according to the rights and regulations of its subject, therefore, it has been able to provide a solid step to prevent the spread of this crime. Also, the efforts made by the European Union following the efforts of the European Council to institutionalize these preventive regulations can be considered.
