fa حق کودک برای داشتن خانواده در ایران: تحلیل اسناد مورد تعهد در جهان اسلام و عرصه بین‌الملل پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="font-size:12px;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#03695f">زمینه و هدف:</span></span></span></b> <span lang="FA"><span b="" nazanin="">هدف اصلی پژوهش حاضر، شناسایی چیستی و چگونگی حق کودکان برای برخورداری از خانواده در اسناد رسمی مورد تعهد ایران در سطح جهان اسلام و بین‌الملل است.</span></span> <span lang="AR-SA"><span b="" nazanin="">رویکرد پژوهش حاضر، کیفی و روش تحقیق نیز تحلیل اسنادی می‌باشد.</span></span><span dir="LTR" lang="NL"><span style="line-height:115%"></span></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#03695f">روش:</span></span></span></b> <span lang="AR-SA"><span b="" nazanin="">رویکرد پژوهش حاضر، کیفی و روش تحقیق نیز تحلیل اسنادی می‌باشد.</span></span><span lang="FA"><span style="font-family:"B Nazanin""></span></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#03695f">یافته‌ها:</span></span></span></b> <span lang="FA"><span b="" nazanin="">یافته‌ها حاکی از آن هستند که در حوزه حق بر داشتم خانواده گذشته از قوانین ایران، احکام شرع و میثاق حقوق کودک در اسلام که ایران نیز بر اساس فرهنگ اسلامی ـ شیعی و تعهدات منطقه‌ای جهان اسلام به آن‌ها پایبند است، پیمان‌نامه کنوانسیون حقوق کودک نیز سیاستگذاری مرجع و تعیین‌کننده حقوق کودکان در سطح بین‌المللی یا &laquo;جامعه جهانی&raquo; است که ایران از اوایل دهه 70 شمسی نیز به آن متعهد شده است.</span></span><span lang="AR-SA"><span style="font-family:"B Nazanin""></span></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><span sans-serif=""><b><span lang="AR-SA"><span b="" nazanin=""><span style="color:#03695f">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span b="" nazanin="">نتایج نشان می‌دهند که برخورداری از خانواده یکی از مهم‌ترین و اساسی‌ترین حقوق برای کودک است و تحقق بسیاری از حقوق کودک به نهاد خانواده وابسته است، اما زمانی که کودک به دلایل مختلفی از نهاد خانواده محروم است، دولت موظف به سرپرستی کودک و ایجاد نهاد جایگزین خانواده برای اوست؛ پیرامون جایگزینی خانواده اختلاف نظرهایی در بین تعهدات جهان اسلام و سطح بین‌المللی وجود دارد، البته نمی‌توان هیچ ‌یک را درست و یا نادرست مطلق دانست، بلکه هر دو طرف جوانب مثبت و منفی خود را دارند که در جریان متن به شکلی جزئی تشریح و تحلیل شدند، اما به طور حتم در دو مورد مذکور، جامعه ایران بر اساس زمینه‌های اجتماعی و فرهنگی خود نسبت به کنوانسیون حقوق کودک متفاوت خواهد بود.</span></span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f4fefe"><b><span style="color:#03695f">Background and Aim:</span></b> The main purpose of the current research is to identify what and how the right of children to have a family is in the official documents committed by Iran at the level of the Islamic world and internationally. The current research approach is qualitative and the research method is document analysis.</span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Method:</span></b> The current research approach is qualitative and the research method is document analysis.</span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Results:</span></b><b> </b>The findings indicate that in the field of family rights, Iran&#39;s laws, Shariah rulings and the Covenant of Children&#39;s Rights in Islam, which Iran adheres to base on Islamic-Shia culture and regional commitments of the Islamic world, The Convention on the Rights of the Child is also the reference and determining policy for children&#39;s rights at the international level or &quot;global community&quot;, which Iran has committed to since the early 70s.</span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Conclusion:</span></b><b> </b>The results show that having a family is one of the most important and basic rights for a child and the realization of many of the child&#39;s rights depends on the institution of the family, but when the child is deprived of family for various reasons, the government is obliged to take care of the child and creating an institution that replaces the family for him; Regarding the replacement of the family, there are differences of opinion between the commitments of the Islamic world and the international level, of course, none of them can be considered absolute right or wrong, but both sides have their pros and cons, which are partially explained in the course of the text were analyzed, but definitely in the two mentioned cases, the society of Iran will be different based on its social and cultural contexts compared to the Convention on the Rights of the Child.</span></span></span></span><br> <br> <span style="font-size:12px;"><span style="line-height:115%"><span sans-serif="" style="font-family:Calibri,"><b><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Please cite this article as:</span></span></b></span></span><br> <span style="line-height:115%"><span sans-serif="" style="font-family:Calibri,"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Sha&rsquo;ban M.
