fa نقش کلینیک‌ها در آموزش دوره‌های حقوق کودک به والدین و سرپرستان قانونی با نگاهی به ماده 43 قانون حمایت از اطفال و نوجوانان پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="font-size:12px;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">زمینه و هدف:</span></span></b> <span lang="AR-SA">کلینیک‌های حقوق کودک نهادهایی نوپا، دانش‌محور و کارکردی محسوب می‌شوند که از جهات مختلف و ضمن تعامل با کودکان، والدین و نهادهای گوناگون در جامعه، تأمین حقوق کودکان را با ابزارهای مختلف در دستور کار خود دارند. این مطالعه با هدف بررسی نقش کلینیک‌های مزبور در آموزش دوره‌های حقوق کودک به والدین و سرپرستان قانونی انجام گرفت.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">روش:</span></span></b> <span lang="FA">تحقیق حاضر یک مطالعه نظری به ‌روش توصیفی ـ تحلیلی بوده و روش جمع‌آوری اطلاعات آن به صورت کتابخانه‌&rlm;ای است</span><span lang="AR-SA">.</span><span lang="FA"><span style="font-family:"B Nazanin""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">یافته‌ها:</span></span></b> <span lang="AR-SA">از مهم‌ترین جهات فلسفه وجودی کلینیک‌های حقوق کودک آموزش و فرهنگ‌سازی در رابطه با حقوق کودکان و انتقال مؤثر مفاهیم مندرج در اسناد بین‌المللی و قوانین و رویه‌های حقوقی داخلی پیرامون کودکان است. برای تثبیت و توسعه جایگاه کلینیک‌های حقوق کودک، اختیارات و بسترهای قانونی در کنار تخصیص امکانات و بودجه مناسب نیاز است. یکی از بسترهای مهمی که در قوانین فعلی برای پیوند و هم‌افزایی میان کلینیک‌ها و نظام قضایی و والدین و به ویژه سرپرستان قانونی فرزندخواندگان تمهید گردیده و می‌بایستی مورد توجه قرار گیرد، ماده 43 قانون حمایت از اطفال و نوجوانان است. بر این اساس قاضی رسیدگی‌کننده می‌تواند در موضوعات مشمول قانون در کلیه مراحل رسیدگی، والدین، اولیا یا سرپرست قانونی اطفال و نوجوان یا سایر اشخاص مرتبط با پرونده را ملزم به شرکت و اخذ گواهی دوره‌های آموزشی حقوق اطفال و نوجوانان کند.<span style="font-family:"B Nazanin""></span></span></span></span><br> <b><span dir="RTL" lang="AR-SA"><span style="color:#03695f">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA">کلینیک‌های حقوق کودک می‌توانند در این زمینه</span><span dir="RTL" lang="FA"> ارائه دوره‌های آموزشی،</span><span dir="RTL" lang="AR-SA"> نقش مهمی ایفا نموده و مرجع خدمات حقوقی باشند. توسعه ماده 43 قانون حمایت و استفاده از آن برای آموزش حقوق کودک به والدین در تمامی فرایندهای دادرسی مرتبط با کودکان و حتی خارج از چارچوب قضایی، امری مهم و ضروری به نظر می‌رسد.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="background:#f4fefe"><b><span style="color:#03695f">Background and Aim:</span></b> <span lang="EN">Children&#39;s rights clinics are new, knowledge-oriented and functional entities that pursue the provision of children&#39;s rights through various means while interacting with children, parents and various institutions. This study was conducted with the aim of investigating the role of these clinics in teaching child rights courses to parents and legal guardians.</span><span style="font-family:"Times New Roman","serif""></span></span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Method:</span></b> The present study is of theoretical type by descriptive-analytical method and the method of data collection is library<span lang="EN">.</span></span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Results:</span></b><b> </b><span lang="EN">One of the most important aspects of the existence of children&#39;s rights clinics is education and culture-building in relation to children&#39;s rights and the transfer of concepts contained in international documents and domestic legal laws and procedures around children. In order to stabilize and develop the position of child rights clinics, legal powers and platforms are needed along with the allocation of facilities and appropriate budget. Article 43 of the Law on the Protection of Children and Adolescents is one of the important platforms that have been prepared in the current laws for the connection and synergy between clinics and the judicial system and parents and especially the legal guardians of adopted children. Based on this, the judge can oblige parents, legal guardians of children and adolescents or other persons related to the case to participate and obtain a certificate of educational courses on children and adolescents law in all the stages of the proceedings.</span><span style="font-family:"Times New Roman","serif""></span></span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Conclusion:</span></b><b> </b><span lang="EN">Children&#39;s law clinics can play an important role in providing training courses and being a reference for legal services.
