fa نگرشی بر مفهوم شناسی، زمینه تاریخی - حقوقی و ضرورت نهاد فرزندخواندگی پژوهشي Original Article <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">زمینه و هدف: </span></span></b><span lang="FA">فرزندخواندگی یا سرپرستی نهادی است که بحث&shy;‌های عدیده&shy;ای پیرامون ماهیت، شرایط، آثار و بایدها و نبایدهای اخلاقی و اجتماعی آن مطرح شده است. در این مطالعه ضمن مفهوم شناسی، به بررسی بستر تاریخی- حقوقی این نهاد با مطالعه&shy;‌ای تطبیقی در اسلام، ایران و انگلستان و همچنین تبیین اهمیت و ضرورت نهاد فرزندخواندگی در جامعه خواهیم پرداخت.</span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">روش:</span></span></b> <span lang="AR-SA">مطالعه حاضر با استفاده از منابع کتابخانه‌&shy;ای و به شیوه توصیفی-تحلیلی به انجام رسیده است.</span><span lang="FA"><span style="font-family:"B Nazanin""></span></span></span></span><br> <span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA"><span style="color:#03695f">یافته‌ها:</span></span></b> <span lang="FA">فرزندخواندگی از دیرباز چاره&shy;ای برای حل مشکلات یتیمی و شبه&shy;‌یتیمی در جوامع مختلف بوده و تفاوت قرائت&shy;‌ها صرفاً در ماهیت این رابطه و آثار برخاسته از آن است. فرزندخواندگی نهادی ضروری در جوامع کنونی به حساب می&shy;‌آید که علاوه بر تأمین منافع کودکان بی&shy;‌سرپرست و زوجین بدون فرزند، تأثیرات اجتماعی مثبتی به دنبال خواهد داشت و نیاز است که قواعد آن با مقتضیات اجتماعی انطباق یابد.</span></span></span><br> <b><span dir="RTL" lang="AR-SA"><span style="color:#03695f">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="FA">رویکرد توسعه&shy;‌ای در پذیرش نهاد فرزندخواندگی توأم با توجه به ابعاد فرهنگی و بومی ضمن رفع موانع و تسهیل شرایط شکلی سرپرستی و کیفی&shy;‌سازی آن با استفاده از ابزار نظارت مستمر، می‌&shy;تواند پاسخی به حل مشکلات کودکان و تجهیز اجتماع در سایه توجه به فرزندخواندگی باشد</span><span dir="RTL" lang="AR-SA">.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="background:#f4fefe"><b><span style="color:#03695f">Background and Aim: </span></b>Adoption or guardianship is an entity<b> </b>that many debates have been raised about its nature, conditions, effects and moral and social dos and don&#39;ts. In this study, along with the concept, we will examine the historical-legal background of this institution with a comparative study in Islam, Iran and England, as well as explain the importance and necessity of the adoption in society.</span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Method:</span></b> The present study was carried out using library resources and descriptive-analytical method<span lang="EN">.</span></span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Results:</span></b><b> </b>Adoption has long been a way to solve the problems of orphans and semi-orphans in different societies, and the difference in attitudes is only in the nature of this relationship and its effects. Adoption is considered a necessary entity<b> </b>in today&#39;s societies, which, in addition to providing the benefits of orphaned children and childless couples, will have positive social effects, and its rules need to be adapted to social requirements<span lang="EN">.</span></span><br> <span style="background:#f4fefe"><b><span style="color:#03695f">Conclusion:</span></b><b> </b>A developmental approach in accepting the entity<b> </b>of adoption, taking into account the cultural and local dimensions, while removing obstacles and facilitating the formal conditions of guardianship and improving its quality by using continuous monitoring tools, can be an answer to solving children&#39;s problems and equipping the community in the shadow of attention to Adoption.</span></span><br> <br> <span style="line-height:115%"><b><span style="line-height:115%">Please cite this article as:</span></b></span><br> <span style="line-height:115%"><span style="line-height:115%">Arastooie M.
