fa چالش‌های حقوق بشری فناوری نوین چت جی‌پی‌تی با تأکید بر حق آموزش کودکان در کنوانسیون حقوق کودک تخصصي Special پژوهشي Original Article <strong><span style="font-size:14px;">زمینه و هدف: هوش مصنوعی در دو دهه گذشته به شدت تکامل یافته است و به جریان اصلی در حوزه‌های مختلف علمی، از جمله آموزش تبدیل شده است، در این میان فناوری نوین چت جی‌پی‌تی (Chat GPT) عمدتاً برای ارتقای خدمات سیستم‌های آموزشی هوشمند اداری و پشتیبانی دانشگاهی استفاده شده است. ابزارهای هوش مصنوعی مولد، به ویژه چت جی‌پی‌تی، از زمان عرضه عمومی در سال 2022 تحول چشم‌گیری در ارتباطات دیجیتال و فرایندهای آموزشی ایجاد کرده است. این فناوری در کنار فرصت‌های قابل توجه برای ارتقای یادگیری، نگرانی‌های حقوقی، اخلاقی و آموزشی مهمی را نیز به ویژه در حوزه آموزش کودکان مطرح می‌کند. این فناوری، یک ربات چت مبتنی بر هوش مصنوعی که توسط شرکت (Open AI) توسعه یافته و در نوامبر 2022 منتشر شده است. فناوری مورد نظر، به دلیل عملکرد چشم‌گیر خود در ایجاد پاسخ‌های جامع، سیستماتیک و آموزنده مانند انسان به ورودی‌های کاربر از طریق پردازش زبان طبیعی، به سرعت مورد توجه کل جامعه بین‌المللی قرار گرفته است. با توجه به چالش‌های حقوقی و اخلاقی استفاده از این فناوری، تحقیق حاضر پیامدهای این فناوری را از حیث آموزش کودکان به مداقه گذارده است. مقاله حاضر با هدف معرفی فناوری چت جی‌پی‌تی، مرور ادبیات نظری و تجربی مرتبط و تحلیل انتقادی پیامدهای حقوقی و اخلاقی به کارگیری هوش مصنوعی مولد در آموزش کودکان تدوین شده است.<br> روش: این مطالعه به روش روایت‌پژوهی و بر اساس رویکرد توصیفی و بر مبنای پژوهش‌های نظری، مطالعات تجربی، کتابخانه‌ای و مرورهای نظام‌مند اخیر، فرصت‌ها، مخاطرات و چالش‌های اخلاقی چت جی‌پی‌تی در حوزه آموزش تحلیل و تلفیق گردیده است. محورهای اصلی شامل صداقت علمی، تفکر نقادانه، حریم خصوصی، انصاف، شفافیت و تولید اطلاعات نادرست توسط هوش مصنوعی است.<br> یافته‌ها: نتایج نشان می‌دهد که اگرچه چت جی‌پی‌تی در نگارش تکالیف، کاهش حجم کار و افزایش دسترسی به منابع یادگیری سودمند است، اما مخاطرات مهمی نیز دارد. پژوهش‌ها نگرانی‌هایی درباره تقلب آموزشی، اتکای بیش از حد به متن تولیدی هوش مصنوعی، تضعیف مهارت‌های تفکر انتقادی، سوگیری، خطاهای استناد و فقدان شفافیت مطرح می‌کنند. مرورهای نظام‌مند حاکی از آن است که حدود 85 درصد مطالعات به مزایا اشاره کرده‌اند، در حالی که تقریباً 97 درصد مطالعات به مخاطرات اخلاقی یا مشکلات مرتبط با صحت محتوای تولیدشده پرداخته‌اند.<br> نتیجه‌گیری: هوش مصنوعی مولد را می‌توان نقطه عطفی در تحول نظام آموزش و حق بر آموزش کودکان دانست، اما استفاده از آن به ویژه برای کودکان نیازمند دقت، سازوکارهای اخلاقی و نظارتی و رویکردهای مسئولانه است. بهره‌گیری از هوش مصنوعی قابل توضیح (XAI) می‌تواند به ارتقای شفافیت، پاسخگویی و اعتماد در محیط‌های یادگیری مبتنی بر هوش مصنوعی کمک کند. فهم عمیق‌تر ابعاد حقوقی و اخلاقی این فناوری برای تضمین استفاده ایمن، منصفانه و قابل اعتماد در نظام آموزش ضروری است.<br> &nbsp;</span></strong> <strong><span style="font-size:14px;">Background and Aim: Generative artificial intelligence (AI) tools, particularly ChatGPT, have rapidly reshaped digital communication and educational practice since their public release in 2022. While ChatGPT provides powerful capabilities for enhancing learning and supporting academic tasks, it also introduces significant legal, ethical and pedagogical concerns, especially in relation to children&rsquo;s education. This article aims to introduce the core technology behind ChatGPT, review the existing body of literature and critically examine the legal and ethical implications of integrating generative AI into educational settings for children.<br> Method: A narrative review of theorethical and empirical studies was conducted, drawing on recent publications and systematic review addressingthe opportunities, risks and ethical challenges of using ChatGPT in education. Key themes-including academic, integrity, critical thinking, privacy, fairness, transparency and AI-generated misinformation - were analyzed and synthesized.<br> Results: The findings indicate that although ChatGPT offers substantial benefits for supporting academic writing, reducing workload and enhancing access to learning resources, serious risks have also been reported. Studies emphasize concerns about academic dishonesty, overreliance on automated text generation, diminished critical thinking skills, biased outputs, lack of transparency and inaccuracies in citations. Systematic reviews report that while approximately 85% of studies identify educational benefits, nearly 97% highlight ethical risks of issue related to the reliability of AI-generated content.<br> Conclusion: Generative AI represents a transformative milestone for contemporary education but requires cautious and responsible integration - particulary when used bt or for children. The adoption of Explainable Artificial Intelligence (XAI) is recommended as a pathway to enhance transparency, accountability and trust in AI-supported learning enviroments.
