fa کودکان کار: هم‌سنجی آرای دیوان اروپایی حقوق بشر و تفاسیر کمیته حقوق کودک Working Children: Comparison of the Judgments of the European Court of Human Rights and the General Comments of the Committee on the Rights of the Child تخصصي Special پژوهشي Original Article زمینه و هدف: پدیده کار کودکان به ‌عنوان یکی از مسائل جدی حقوق بشر، همواره مورد توجه نهادهای بین‌المللی قرار گرفته است. دیوان اروپایی حقوق بشر و کمیته حقوق کودک از مهم‌ترین نهادهای حقوقی هستند که نقش مؤثری در حمایت از حقوق کودکان و مقابله با کار کودکان ایفا می‌کنند. این مقاله به بررسی و هم‌سنجی آرای دیوان اروپایی حقوق بشر و تفاسیر کمیته حقوق کودک می‌پردازد تا تفاوت‌ها و شباهت‌های این دو نهاد در مواجهه با مسأله کار کودکان تحلیل شود. روش: این پژوهش با استفاده از روش تحلیلی ـ تطبیقی، ابتدا به بررسی آرا و تصمیمات دیوان اروپایی حقوق بشر در خصوص کار کودکان پرداخته و سپس تفاسیر و توصیه‌های کمیته حقوق کودک را تحلیل می‌کند. در نهایت، با تطبیق دیدگاه‌های این دو نهاد، نقاط اشتراک و افتراق آن‌ها مشخص می‌شود. یافته‌ها: یافته‌های این تحقیق نشان می‌دهد که دیوان اروپایی حقوق بشر و کمیته حقوق کودک هر دو بر اهمیت حفاظت از حقوق کودکان کار تأکید دارند، اما در رویکردهای اجرایی و نحوه برخورد با موارد نقض این حقوق تفاوت‌هایی وجود دارد. دیوان اروپایی عمدتاً به‌ صورت قضایی و موردی به مسائل می‌پردازد، در حالی که کمیته حقوق کودک بیشتر از طریق تفاسیر عمومی و گزارش‌های دوره‌ای بر دولت‌ها نظارت دارد. نتیجه‌گیری: نتیجه‌گیری این مقاله نشان می‌دهد که همسویی و هماهنگی بیشتری بین نهادهای بین‌المللی حقوق بشر برای مقابله مؤثرتر با پدیده کار کودکان مورد نیاز است. دیوان اروپایی حقوق بشر و کمیته حقوق کودک، هر یک با رویکردهای خاص خود، سهم قابل ‌توجهی در بهبود وضعیت حقوق کودکان کار دارند، اما همکاری و تعامل بیشتر این دو نهاد می‌تواند به نتایج مؤثرتری در زمینه مقابله با کار کودکان منجر شود.   Background and Aim: Background and purpose: The phenomenon of child labor, as one of the serious human rights issues, has always been the focus of international organizations. The European Court of Human Rights and the Committee on the Rights of the Child are among the most important legal institutions that play an effective role in protecting children's rights and combating child labor. This article examines and compares the opinions of the European Court of Human Rights and the interpretations of the Committee on the Rights of the Child in order to analyze the differences and similarities of these two institutions in dealing with the issue of child labor. Method: Using the analytical-adaptive method, this research first examines the opinions and decisions of the European Court of Human Rights regarding child labor and then analyzes the interpretations and recommendations of the Committee on the Rights of the Child. Finally, by matching the views of these two institutions, their points of commonality and difference are determined. Results: The findings of this research show that the European Court of Human Rights and the Committee on the Rights of the Child both emphasize the importance of protecting the rights of working children, but there are differences in the implementation approaches and how to deal with violations of these rights. The European Court deals primarily with cases on a case-by-case basis, while the Committee on the Rights of the Child monitors governments more through public commentaries and periodic reports. Conclusion: The conclusion of this article shows that more alignment and coordination between international human rights institutions is needed to deal more effectively with the phenomenon of child labor. The European Court of Human Rights and the Committee on the Rights of the Child, each with their own approaches, have a significant contribution to improving the rights of working children, but greater cooperation and interaction between these two institutions can lead to more effective results in dealing with child labor.   حقوق کودک؛ کودکان کار؛ دیوان اروپایی حقوق بشر؛ کمیته حقوق کودک.
