fa تعامل عدالت اجتماعی و عدالت کیفری با تأکید بر تضمین حق‌های افتراقی کودکان و نوجوانان The Interaction of Social Justice and Criminal Justice through Active and Reactive Policies; with Emphasis on Guaranteeing the Differential Rights of Children and Adolescents تخصصي Special پژوهشي Original Article زمینه و هدف: بزهکاری اطفال و نوجوانان یکی از مهم‌ترین دغدغه‌های نظام‌های حقوق کیفری در جهان محسوب می‌گردد. پیشگیری از این پدیده در دستور کار کنشگران بین‌المللی و ملی سیستم عدالت کیفری قرار گرفته است. عدالت اجتماعی به عنوان مهم‌ترین مقوله تأثیر‌گذار در پیشگیری از بزهکاری اطفال و نوجوانان، از مؤلفه‌های برابری فرصت‌ها، توزیع عادلانه ثروت، رفتار کرامت‌مدار با انسان‌ها و ساختارمندنمودن نهادهای اجتماعی علی‌الخصوص نهاد خانواده تبعیت می‌کند. روش: این پژوهش با روش توصیفی ـ تحلیلی انجام شده است. یافته‌ها: تحقق عدالت اجتماعی تأثیر به‌سزایی در پیشگیری از بزهکاری اطفال و نوجوانان دارد و اسناد فرادستی و فرودستی به ویژه قانون اساسی و برنامه هفتم توسعه بر ضرورت تحقق شاخص‌های عدالت اجتماعی تأکید نموده‌اند. نتیجه‌گیری: این پژوهش ضمن برقراریِ تحلیل‌مند ارتباط مثبت بین عدالت اجتماعی و پیشگیری از بزهکاری اطفال و نوجوانان بر این نکته تأکید دارد که عدالت اجتماعی تنها به پیشگیری کنشی محدود نمی‌شود، بلکه در مرحله واکنشی نیز، برای جلوگیری از تکرار جرم، باید پاسخ‌های متفاوت و شیوه‌های دادرسی ویژه برای نوجوانان بزهکار در نظر گرفته شود. این رویکرد، بخش جدایی‌ناپذیرِ عدالت اجتماعیِ مبتنی بر رفتار احترام‌آمیز و کرامت‌محور با آنان تلقی می‌گردد. از سوی دیگر، برای پیشگیری از بزهکاری، حمایت‌های کیفری لازم از کودکان باید به گونه‌ای انجام شود که حقوق اساسی آنان، از جمله حق بر آموزش و تحصیل به طور کامل تضمین گردد، اگرچه قوانین مختلف با بهره‌گیری از سیاست جنایی افتراقی به این موضوع پرداخته‌اند، اما این مقررات با چالش‌های عملی رو به رو هستند که پژوهش حاضر به تفصیل به بررسی آن‌ها می‌پردازد.   Background and Aim: Juvenile delinquency is considered one of the most important concerns of criminal justice systems in the world. Prevention of this phenomenon is on the agenda of international and national activists within the criminal justice system. Social justice as the most influential factor in preventing juvenile delinquency encompasses components such as equal opportunities, fair distribution of wealth, dignified behavior with people, and structuring of social institutions, especially the family institution. Method: This research was done with a descriptive-analytical method. Results: The realization of social justice has a significant impact on the prevention of delinquency among children and adolescents, and the above-mentioned and subordinate documents, especially the Constitution and the 7th Development Plan, have emphasized the necessity of realizing the indicators of social justice. Conclusion: This study, while establishing an analytical positive correlation between social justice and the prevention of juvenile delinquency, emphasizes that social justice is not limited to proactive prevention. Rather, at the reactive stage, in order to prevent recidivism, differential responses and specialized judicial procedures for juvenile offenders must be considered. This approach is regarded as an integral part of a social justice framework based on respectful and dignity-oriented treatment of them. Moreover, to prevent delinquency, necessary criminal protections for children must be implemented in a way that fully guarantees their fundamental rights, including the right to education and schooling.
