fa حمایت از کودکان در مخاصمات مسلحانه در پرتو تحولات حقوق بین‌الملل بشردوستانه و فناوری‌های نوین جنگ The Protection of Children in Armed Conflicts in Light of Developments in International Humanitarian Law and Emerging Military Technologies تخصصي Special پژوهشي Original Article <table align="center" class="Table" dir="rtl" height="385" style="border-collapse: collapse;" width="567"> <tbody> <tr> <td style="border-bottom:2px solid #50d4c1; width:643px; padding:0in 0in 0in 0in; height:23px; background-color:#f7f7f7; border-top:none; border-right:none; border-left:none"> <table align="right" class="Table" dir="rtl" height="407" style="background: rgb(244, 254, 254); border-collapse: collapse;" width="641"> <tbody> <tr> <td style="border-bottom:none; width:657px; padding:0in 7px 0in 7px; background-color:#f4fefe; border-top:2px solid #50d4c1; border-right:none; border-left:none" valign="top">زمینه و هدف: تحولات معاصر در ماهیت مخاصمات مسلحانه و ظهور فناوری‌های نوین جنگی، چالش‌های تازه‌ای را در زمینه حمایت از کودکان به‌ عنوان آسیب‌پذیرترین گروه غیر نظامی ایجاد کرده است. کودکان در مخاصمات مسلحانه به ‌طور نامتناسبی در معرض نقض حقوق بنیادین، از جمله حق بر حیات، سلامت، امنیت، آموزش و رشد قرار می‌گیرند. هدف این پژوهش، تحلیل تکالیف دولت‌ها و طرف‌های مخاصمه در حمایت از کودکان و ارزیابی کارآمدی سازوکارهای حقوق بین‌الملل بشردوستانه در پرتو تحولات نوین جنگ است. روش: این پژوهش از نظر هدف کاربردی و از نظر روش، توصیفی ـ تحلیلی است. داده‌ها از طریق مطالعه کتابخانه‌ای و تحلیل اسناد بین‌المللی، از جمله کنوانسیون‌های چهارگانه ژنو، پروتکل‌های الحاقی، کنوانسیون حقوق کودک، و سایر اسناد و رویه‌های مرتبط گردآوری و تحلیل شده‌اند. یافته‌ها: یافته‌ها نشان می‌دهد که حقوق بین‌الملل بشردوستانه و حقوق بین‌الملل بشر چهارچوب نسبتاً جامعی برای حمایت از کودکان در مخاصمات مسلحانه فراهم کرده‌اند، با این حال تحولات فناورانه در شیوه‌های جنگ، از جمله استفاده از فناوری‌های پیشرفته و افزایش حملات علیه مناطق غیر نظامی، شکاف‌هایی جدی میان هنجارهای حقوقی و اجرای عملی آن‌ها ایجاد کرده است. این وضعیت موجب تشدید آسیب‌های جسمی و روانی کودکان و افزایش موارد نقض گسترده حقوق آنان شده است. نتیجه‌گیری: نتایج پژوهش نشان می‌دهد که حمایت مؤثر از کودکان در مخاصمات مسلحانه مستلزم تقویت سازوکارهای اجرایی حقوق بین‌الملل بشردوستانه، توسعه تفسیرهای نوین متناسب با فناوری‌های جنگی جدید و افزایش مسئولیت‌پذیری دولت‌ها و سایر بازیگران مخاصمه است. بدون بازاندیشی در چهارچوب‌های حقوقی موجود و تضمین اجرای مؤثر آن‌ها، حمایت واقعی از کودکان در شرایط جنگی تحقق نخواهد یافت.  </td> </tr> </tbody> </table> </td> </tr> </tbody> </table> Background and Aim: Contemporary transformations in the nature of armed conflicts and the emergence of new military technologies have created new challenges for the protection of children as the most vulnerable civilian group. Children in armed conflicts are disproportionately exposed to violations of their fundamental rights, including the rights to life, health, security, education and development. This study aims to analyze the obligations of states and parties to armed conflict in protecting children and to evaluate the effectiveness of international humanitarian law mechanisms in light of recent transformations in warfare. Methods: This research is applied in terms of purpose and descriptive-analytical in terms of methodology. Data were collected and analyzed through library-based research and the examination of international legal instruments, including the four Geneva Conventions, the Additional Protocols, the Convention on the Rights of the Child and other relevant documents and practices. Results: The findings indicate that international humanitarian law and international human rights law provide a relatively comprehensive framework for the protection of children in armed conflicts. However, technological developments in methods of warfare, including the use of advanced military technologies and the increasing number of attacks against civilian areas, have created significant gaps between legal norms and their practical implementation. This situation has intensified the physical and psychological harm suffered by children and has contributed to the growing incidence of widespread violations of their rights. Conclusion: The results of the study demonstrate that effective protection of children in armed conflicts requires strengthening the implementation mechanisms of international humanitarian law, developing updated interpretations compatible with new military technologies and enhancing the accountability of states and other parties to armed conflict. Without reconsidering existing legal frameworks and ensuring their effective enforcement, genuine protection of children in situations of armed conflict will not be achieved.   کودکان؛ مخاصمات مسلحانه؛ حقوق بین‌الملل بشردوستانه؛ فناوری‌های نوین جنگ؛ حمایت از غیر نظامیان؛ حقوق کودک.
